Terms and Conditions

Effective Date: 15 April 2025

Welcome to Long Haul Solutions. These Terms and Conditions govern the use of our services, including website development, LMIS, LMS, eLearning integration, mobile applications, and related solutions.

1. Definitions

  • “Company,” “we,” “our,” or “us” refers to Long Haul Solutions.
  • “Client,” “you,” or “your” refers to the individual or entity engaging our services.
  • “Project” refers to the scope of work defined and agreed upon.
  • “Deliverables” refers to the completed systems, websites, or solutions provided.

2. Scope of Services

Our offerings include:

  • Website Design & Development
  • Learning Management System (LMS) Design
  • Learner Management Information System (LMIS)
  • eLearning & Mobile App Integration
  • Website Hosting & Maintenance
  • Hybrid Accreditation Assistance

3. Client Responsibilities

  • Provide timely, accurate, and complete content and feedback.
  • Acknowledge that delays from your side may impact project timelines and final delivery.

4. Payment Terms

  • Payment terms and deposits will be defined in your official quote or agreement.
  • A non-refundable deposit is required to initiate any project.
  • Final payment is due upon completion and prior to final handover unless otherwise agreed.
  • Late payments may result in paused services or additional charges.

5. Project Timelines

  • Timelines are estimates based on mutual cooperation and responsiveness.
  • Unforeseen delays will be communicated as early as possible.

6. Intellectual Property

  • Upon full payment, you hold all rights to the project content (excluding licensed third-party materials).
  • We retain the right to feature the project in our portfolio or marketing materials.

7. Confidentiality & POPI Act Compliance

  • We comply with South Africa’s POPI Act in protecting your personal and business data.
  • All client data is treated as confidential and will not be shared without permission.

8. Hosting & Backups

  • If hosting is provided by Long Haul Solutions, we offer regular backups and system updates.
  • Clients are encouraged to also maintain independent backups.

9. Communication & Support

  • Our operating hours are Monday to Thursday, 08:00–16:00 (GMT+2). Friday 8:00–13:00 (GMT+2)
  • Support is available via email, WhatsApp, or phone during working hours.
  • Weekend support is limited to urgent functionality issues such as downtime.

10. Free Support Period & Ongoing Maintenance

  • Each project includes a 30-day free support window after completion, covering basic bug fixes and minor assistance.
  • After this period, clients must subscribe to our Monthly Support Plan or request paid ad-hoc support.
  • Monthly plans start at R150.00/month and cover updates, technical assistance, and performance monitoring.

11. Limitation of Liability

  • We are not responsible for data loss, third-party service failure, or indirect damages.
  • Clients agree to indemnify Long Haul Solutions from any claims arising from misuse of our deliverables.

12. Termination & Refund Policy

  • Either party may terminate this agreement in writing with valid cause.
  • The Client will be invoiced for all completed work to the date of termination.

13. Change Requests & Final Revisions

  • Each website project includes one round of final changes after the first full draft is submitted.
  • Clients must submit all final changes in one written document or message within five (5) business days of draft delivery.
  • Additional changes beyond the included round will be treated as extra work and quoted at our standard hourly or per-change rate.
  • Failure to submit consolidated changes within the timeframe may result in the project being finalized as-is or delayed accordingly.
  • By proceeding with Long Haul Solutions, the client agrees to these revision boundaries to ensure fair and efficient project delivery.

14. Amendments

We reserve the right to update these terms periodically. Clients will be notified of any changes via email or website notice.

15. Governing Law

These terms are governed by the laws of the Republic of South Africa.

17. System Training & Post-Project Assistance

  • All LMIS, LMS, and software projects include basic training and video tutorials provided at the time of handover.
  • Clients are responsible for ensuring that their team is trained using these materials during the onboarding period.
  • Requests for additional training, support, or system usage guidance beyond 30 days after project completion will be billed separately.
  • We offer paid refresher Zoom sessions, staff re-training, or technical walk-throughs upon request.
  • We encourage clients to make use of the video tutorials provided before requesting further support.
